The Regulations are due to come into force on 1 October 2022 and affect both private and social housing landlords in England and Wales.
The main changes are:
- CO alarms are now required where there is any fitted combustion appliance other than a gas cooker (includes gas and oil-fired boilers)
- New provision requiring landlords to repair or replace a non-working smoke or CO alarm ‘as soon as reasonably practicable’ if a tenant or their representative reports it as not working
What it means for Landlords
The regulations will apply to all tenancies from 1 October 2022. At Howard we recommend all rental properties should already have a CO alarm fitted where there is a fitted combustion appliance like a boiler, as ultimately it will protect your tenants and provide peace of mind.

- Arrange the supply and fit of alarms when required.
- Check the smoke and CO alarms are in working order at the start of a new tenancy*
- Remind tenants of their obligation to test and install new batteries if needed during their tenancy.
- Notify landlords immediately if there is an issue reported by the tenant.
- Work with landlords and tenants to arrange swift repair or replacement of any damaged or faulty alarms.
